Terms of Service
The rules for using uscale, what you own, and what we are responsible for.
1. Who we are
uscale (the "Service") is operated by Scaleform OÜ, a private limited company registered in Estonia under registry code 17409408, with its registered address at Tornimäe tn 5, Kesklinna linnaosa, 10145 Tallinn, Harju maakond, Estonia ("we", "us"). These Terms are an agreement between us and you, or the organisation you act for, when you use uscale.ai, app.uscale.ai or the uscale API.
2. The Service
uscale turns a product into launch videos. You give us a product URL or code repository, and optionally logins, files and instructions. We open the product in a browser on our servers, record it, write copy and narration with AI models, design animated scenes and render videos you can download.
The Service is in active development. Features, presets and limits may change, and we may add, change or remove functionality at any time.
3. Your account
- You sign in with an email address. Keep access to that mailbox secure: anyone who can read it can sign in as you.
- You are responsible for everything done under your account, including by people you invite to a workspace.
- You must be at least 18 and able to enter into a binding contract. If you use uscale for an organisation, you confirm you may accept these Terms on its behalf.
4. Your content and your products
"Your Content" means everything you provide or that we capture on your instruction: URLs, repositories, logins, uploaded files, logos, reference videos, chat messages, screen recordings and screenshots of your product.
- You keep ownership of Your Content. You give us a limited licence to host, copy, process and transform it only to provide the Service to you, including sending it to the service providers listed in our Privacy Policy.
- You must have the right to film what you point us at. Only give us URLs, repositories and logins for products you own or are authorised to access and record. Do not give us credentials you are not permitted to share.
- Logins you give us are stored encrypted and used only to sign in to the product you asked us to film. You can remove them at any time in the app.
5. The videos we make for you
- You own the videos, scripts, captions and post copy we generate for you, to the extent we hold any rights in them, and you may use them for any lawful purpose.
- Output is produced with AI models and may contain mistakes. We check numbers against your product's own words and against facts you tell us, but you are responsible for reviewing everything before you publish it and for the accuracy of the claims it makes.
- Videos can show third-party names and logos, for example tools your product integrates with. Those marks belong to their owners. You are responsible for having the right to use them in what you publish.
- Similar prompts can lead to similar output for other customers. We do not promise that output is unique to you.
6. Acceptable use
You agree not to use the Service to:
- record, copy or misrepresent products, people or brands without permission, or impersonate anyone;
- create content that is unlawful, infringing, defamatory, deceptive, hateful or sexually explicit;
- access systems you are not authorised to access, or use the Service to get around security controls;
- interfere with, overload, probe or reverse-engineer the Service, or access it by automated means other than the API we provide;
- resell or provide the Service to third parties as your own, unless we agree in writing.
We may refuse or remove content, and suspend access, where we reasonably believe these rules are broken.
7. Plans, credits and fees
Some features require a paid plan or credits. Prices, what they include and any taxes are shown before you buy. Unless the law requires otherwise or we say so at purchase, fees and used credits are not refundable. We may change prices for future periods with reasonable notice.
8. Third-party services
The Service relies on third-party providers, for example AI model, voice, video-generation and hosting providers, listed in our Privacy Policy. Their availability can affect the Service. Your use of any third-party product you connect or film remains subject to that product's own terms.
9. Availability
We work to keep uscale available and your data safe, but the Service is provided "as is" and "as available". To the extent the law allows, we make no warranties about fitness for a particular purpose, uninterrupted operation or error-free output.
10. Liability
- To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost revenue or lost data.
- Our total liability for all claims relating to the Service in any 12-month period is limited to the fees you paid us in that period, or EUR 100 if you paid nothing.
- Nothing in these Terms limits liability that cannot be limited by law, including liability for intent or gross negligence, or your rights as a consumer under mandatory law.
11. Your responsibility to us
If a third party brings a claim against us because of Your Content, a product or login you gave us without authorisation, or your breach of these Terms, you will compensate us for the resulting reasonable costs and losses, except to the extent we caused them.
12. Ending the agreement
You can stop using uscale at any time and ask us to delete your account. We may suspend or end your access if you seriously or repeatedly breach these Terms, or if we stop offering the Service, in which case we will give you reasonable notice and time to download your videos where we can.
13. Changes to these Terms
We may update these Terms. If a change materially affects you, we will tell you by email or in the app before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
14. Law and disputes
These Terms are governed by the laws of the Republic of Estonia. Disputes will be resolved by Harju County Court (Harju Maakohus) in Tallinn, unless mandatory consumer law gives you the right to bring proceedings in your country of residence.
